Terms of Service

These Terms of Service ("Terms") govern your access to and use of LeadsUp Tracer (the "Service"), operated by LeadsUp ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

LeadsUp Tracer turns names and property/address information you provide (or source through the Service) into contact data such as phone numbers and email addresses, for lead-generation and outreach purposes. We grant you a non-exclusive, non-transferable right to use the Service subject to these Terms and your plan limits.

2. Permitted use & compliance (important)

The Service and its data are provided for lead generation only. We are not a consumer reporting agency and the data is not a "consumer report" under the Fair Credit Reporting Act (FCRA). You agree that you will not use the Service or any data, in whole or in part, for any purpose regulated by the FCRA, including determining eligibility for credit, insurance, employment, housing/tenancy, or any other FCRA-permissible purpose.

You are solely responsible for your outreach. Before contacting any person, you must comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA), state telemarketing laws, and the National Do-Not-Call (DNC) Registry. The Service's DNC indicators are provided as a convenience and do not guarantee compliance; you must independently scrub and obtain any required consent.

3. Your responsibilities

You represent that you have a lawful basis to process the data you submit and obtain, that your use complies with all applicable laws, and that you will not use the Service to harass, defraud, or harm any person. You are responsible for all activity under your account and for keeping your credentials secure.

4. Plans, credits & billing

Paid plans and credit top-ups are billed as described at checkout. Subscriptions renew automatically until canceled; you can change or cancel your plan at any time, with changes prorated by our payment processor. Usage-based charges (data sourcing, add-ons, and traces beyond your plan) are drawn from your credit balance. Except where required by law, payments are non-refundable.

5. Acceptable use

Your use is also governed by our Acceptable Use Policy, which is incorporated into these Terms. We may suspend or terminate accounts that violate these Terms or that policy.

6. Data & privacy

Our handling of personal information is described in our Privacy Policy.

7. Disclaimers & limitation of liability

The Service and all data are provided "as is" without warranties of any kind, including accuracy, completeness, or fitness for a particular purpose. Contact data may be inaccurate or out of date. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the three months preceding the claim.

8. Indemnification

You agree to indemnify and hold us harmless from any claims arising out of your use of the Service or data, including any violation of these Terms or applicable law (including FCRA, TCPA, or DNC rules).

9. Changes & termination

We may update these Terms; material changes will be posted here with a new date. We may suspend or terminate access for violations. You may stop using the Service at any time.
